Terms and Conditions for the Lenz Moser Onlineshop

Scope of application:
These Business Terms regulate the sale of products sold to you by GHG Getränkehandelshaus GesmbH in 4030 Linz, Bäckermühlweg 44, company register number FN 80908h, VAT ID number ATU36902205, in our online shop on the website www.lenzmoser.at.
GHG Getränkehandelshaus GesmbH is a wholly owned subsidiary of Weinkellerei Lenz Moser AG. Weinkellerei Lenz Moser AG has its registered offices in 3495 Rohrendorf bei Krems, Lenz Moser Strasse 1, www.lenzmoser.at.

Contract conclusion:
Your order constitutes an offer to GHG Getränkehandelshaus GesmbH to conclude a purchase agreement when shopping at the online shop of the website www.lenzmoser.at. When you submit an order we confirm receipt of your order for you by email by means of an order confirmation that lists all details. A purchase agreement only comes about when payment for the merchandise has reached us and we then ship the product ordered to you.
Payment of the merchandise ordered is made exclusively by credit card (VISA verified by Visa and MASTERCARD Secure Code) or by payment in advance.
Without prejudice to your right to withdraw (also revocation right) you may at any time and without charge cancel your order for a product prior to its shipment to you.
You hereby give your consent to receiving invoices electronically in PDF format.
We assume that you meet the age limit requirements for the purchase of alcoholic beverages.

Right of withdrawal (revocation right) up to 14 days
You have the right to revoke this contract, without giving any reasons, within 14 days from the date on which you or a third party designated by you took possession of the merchandise.
You may send your statement in any form you choose by email to shop(at)lenzmoser.at or by fax to +43 2732 85900. That statement must contain:

To meet the withdrawal deadline of 14 days it suffices that you dispatch the notification about exercise of the right of withdrawal by the withdrawal deadline. You must return the merchandise to us without delay and in any case at the latest within 14 days of the day on which you notified us of your withdrawal from the contract. The deadline is met if you dispatch the merchandise before the 14-day deadline runs up.
You must bear the regular costs of return shipment if the merchandise delivered corresponds to the merchandise ordered and if the price of the returned merchandise does not exceed an amount of euro 40.
After arrival of the returned merchandise at our premises you will receive the purchase sum without delay, at the latest within 14 days, returned to the same means of payment as the one used to pay. No fees will be charged to you for this refund.

Prices
Price information for products applies at the time of ordering from the online shop at www.lenzmoser.at.
All prices are gross prices (in euro) and include all Austrian taxes.

Basically, no discounts are given.

Payment
Payment for merchandise ordered is made exclusively by credit card (VISA verified by Visa and MASTERCARD Secure Code) or by payment in advance.
Your personal data and the information about your credit card are protected by modern security systems. The transfer of such data occurs with encryption and is rendered unreadable for outsiders by using secure socket layers (SSL), one of the best security standards at present. Your card is only debited when we have undertaken shipment.
In case of partial deliveries the partial amounts are collected each time.
Clearing occurs via the firm of GHG Getränkehandelshaus GesmbH, 4030 Linz, Bäckermühlweg 44.

Retained ownership title
Each product delivered remains the property of GHG Getränkehandelshaus GesmbH up through complete payment.

Delivery
Delivery is made to the delivery address you have given. Please ensure that the latter has been given correctly. Additional information such as delivery time or a telephone number make it easier for the commissioned logistics company to make delivery. Should delivery not be possible, a notice of delivery will be left at your address. If delivery is still not possible then the shipment will be returned to our premises. In that case the purchase sum will be refunded. For delivery within the EU, on average a period of seven workdays from the order date is required. Delivery is either made by postal service or, upwards of a certain delivery quantity, by a forwarding agent.
The bottles of vintage wines (wines from the years 1960 to 1985) are given a rough cleaning before delivery. Should you not want this, please inform us of this in the text field “Special wishes” on the order form. Deliveries outside of the EU are currently only possible by special request.

Complaints about deliveries:
All products are carefully checked before they are dispatched. Please also check your delivery immediately upon receipt for shipping damages, completeness and correctness. By way of information: all products are shipment insured. Shipping damages must therefore be reported immediately upon receipt and additionally announced by email or fax. Complaints received at a later date cannot be acknowledged.

Freight costs:
We deliver carriage free within Austria and outside of Austria as well for orders of euro 150 or more (within the EU).

For orders under euro 150 outside of Austria the freight charges are shown in the invoice total (see also the shopping cart) and added on (Benelux, Czech Republic, Denmark, France, Germany, Hungary, Italy/San Marino, Poland, Slovakia, Slovenia, Sweden, United Kingdom: euro 15; Finland, Ireland: euro 30; Portugal, Spain: euro 45).

Customs, taxes and charges
Our product prices contain only statutory Austrian taxes. If additional import duties, taxes as well as charges for customs clearance are incurred in the recipient country then these must be paid by the buyer.
Please ensure that you as the buyer comply with all laws and regulations of the recipient country.

Offers:
Our offers are not binding and without obligation. The quantities in the shop are up to date, but not current by the hour. Due to the limited volume of certain vintage years, a sell-out situation may occur while you are ordering. We ask for your understanding that we must always accept the first order to come in.
Should an item you have ordered be sold out then you will be informed about this by email.

Seller’s right of withdrawal:
In case of force majeure we are entitled to withdraw from the contract without the buyer being able to raise damage compensation claims for failure to fulfil.

Disclaimer:
We do not assume any responsibility for any damages or losses caused to the buyer by use of the software and/or the purchase of products in the virtual shop.

Quality:
For all products that can be ordered via our shop we or our oenologists, who regularly taste the wines, guarantee flawless quality. Should you nevertheless have occasion to complain then please inform us per email or fax. Your complaint will be answered promptly.

Corks:
It can unfortunately not be excluded that a wine sealed with a natural cork has a flaw in the cork. Naturally you will in that case be given a replacement by delivery of merchandise of equivalent value. Please transmit any information on this by email or fax.

Product illustrations:
These may differ from the appearance of the products delivered, particularly in case of vintage wines or due to different bottle shapes.

Lenz Moser Club:
Automatically with your order you will be enrolled in the Lenz Moser Club. Membership is free. Should you not wish to join then please select the option provided for this on the order form.

Data protection declaration
For the use of our website generally no provision of personally identifiable information is required. The disclosure of personal details (such as name, address, email address) for ordering in the Lenz Moser online shop, for enrolment in the Lenz Moser Club or to receive the newsletter is at all times voluntary. Such data will not be forwarded to third parties without your express consent.
We neither collect nor use data traces (such as cookies), which are generated when you visit our website, in a personally identifiable way.
Data transmission via the internet may not be without security gaps so please protect yourself with corresponding precautions. We wish to point out that airtight protection against access by third parties is nonetheless not possible.
Should you wish to have your personally identifiable information deleted you may contact us about this at any time and free of charge. We wish to point out that you are entitled to have erroneous data corrected or to have personally identifiable information deleted, provided this demand does not run counter to any statutory retention periods.
